New Legionella Regulations for Lettings

As anyone dealing in tenanted property will be aware, we have all been inundated with new legislation over the past few years.

We are able to deal with all the changes in law which are about to come into effect, such as the additional checks for Residence Status (Immigration Act 2014) for all tenancy applicants and The Deregulation Bill with simple amendments to our current procedures.

However, the new regulation causing the most upheaval and additional work in our own office is the Health & Safety Executive’s new guidelines on the control of legionella bacteria in water systems. This can cause Legionnaires’ disease which is a potentially fatal form of pneumonia.

We are arranging for all tenanted properties under our management to have their water systems inspected and a full report drawn up, to include a plan of the water system, a risk-assessment and advice notes on future management. This work will be undertaken by a professionally trained and accredited organisation.

We are also advised that further checks will need to be made on a regular basis to ensure that water temperature is managed so that bacteria does not proliferate in the water system. (This means hot enough at point of delivery 50° at taps, 41° at (TMV) Thermostat mixer valves, and 20° or below at cold outlets.) Any empty properties should be visited once a week in order to run all taps.

It is further recommended that the standard shower heads are cleaned regularly. Advice at courses attended, has suggested that it may be more economically sound to actually replace the shower head on an annual basis as these items are relatively inexpensive.

We are currently writing to all our clients and tenants advising them of the new regulations and providing advice notes on what action they need to take themselves.
